Incorrect Declaration (Art. 79 TULD)

A customs declaration that results in an incorrect assessment of customs duties (duties and VAT) is considered an act of smuggling, regardless of whether the error was intentional.

Administrative Sanctions (Art. 96)

• In the case of a customs declaration containing multiple items, negative and positive balances related to each item must be offset separately with reference to duties and VAT.
• If, during inspection, goods different from those declared are found, the violation will apply exclusively to the item concerned.
• For the determination of sanctions, the most favorable criterion for the economic operator will apply:
  • Legal cumulation: application of the sanction for the most serious violation.
  • Material cumulation: sum of the sanctions provided for each violation.

Extinction of Smuggling Offenses Punishable by Fine Only (Art. 112)

If the customs duties due do not exceed €50,000 and no aggravating circumstances apply, the offense is extinguished by payment of the pecuniary sanction and the duties owed, even if criminal proceedings are pending.
It is also possible to regularize the situation through voluntary disclosure (ravvedimento operoso, Art. 13 of Legislative Decree 472/1997), provided that the Customs Office has not yet determined the sanction.

Application of Confiscation (Art. 96 and 112)

• In cases where the smuggling offense is extinguished by payment, confiscation is not automatic.
• The exemptions provided by current legislation may apply, in particular Art. 96, paragraph 9.

Conclusions

The reform represents an important step toward greater clarity and proportionality in the application of customs rules. However, it also requires greater attention in the management of customs declarations to avoid liability, including criminal liability.

Starting from July 1, 2024, all international shipments with a goods value exceeding €2,500 that transit through Romania must be reported to the RO e-Transport system and obtain UIT/ITU codes.
This requirement applies not only to high fiscal risk goods but to all goods in general. The goal is to reduce tax evasion, close the VAT gap, and prevent illegal trade.

Who must notify the shipment?

The obligation to notify the shipment to the RO e-Transport system for the issuance of the UIT code lies with various parties involved in international goods transport in Romania, including:

• the consignee indicated in the customs import declaration,
• the exporter indicated in the customs export declaration,
• the consignee in Romania for intra-EU acquisitions, and
  the supplier in Romania for domestic transactions or intra-EU deliveries.

Data required for the issuance of the UIT/ITU code

To obtain the UIT/ITU code, the following information is required: details of the consignor and consignee, characteristics of the goods, loading and unloading locations, and details of the means of transport.

Timeframe for UIT code issuance

The ITU code can be requested up to 3 calendar days before the identified transport start date and is valid for 5 calendar days from the transport date recorded in the system.

What happens if the UIT code expires?

If the UIT code expires, customs authorities may block the shipment or require additional checks. This could lead to penalties, delays in the customs clearance process, and additional costs.

Subcontracting (toll manufacturing) and UIT code

If you carry out toll manufacturing in Romania involving the import of goods from EU countries, you are required to issue the UIT code. However, there are some exceptions for goods under temporary import.

What happens if a truck has multiple shipments and only one lacks a UIT code?

In the case of a truck carrying multiple shipments where only one lacks the UIT code, Romanian authorities should not automatically block the entire truck. However, the shipment without the UIT code may be subject to additional checks and could affect the others.

Last month, the German Parliament and the Federal Council officially approved the increase in German road toll rates (Lkw-Maut).
The truck toll will be extended with a CO₂ surcharge, and the toll threshold will be reduced from 7.5 to >3.5 tons.

Some background information on the German MAUT toll system:

1. Vehicles concerned: Initially, the MAUT mainly applied to heavy vehicles with a total weight exceeding 7.5 tons. Lighter vehicles, including private cars, were not subject to the toll.
2. Toll roads: The MAUT generally applied to motorways and selected federal roads in Germany. Local roads were not included in the toll system.
3. Toll calculation: The MAUT toll was based on the distance traveled and the vehicle’s CO₂ emissions. More polluting vehicles were subject to higher tolls.
4. Payment systems: Heavy vehicle drivers had to register and pay the toll through various systems, such as onboard units or online registration. Payment could be made per kilometer traveled or via a fixed fee.

According to official transport sector sources, the new tariffs will take effect from December 1, 2023, and the new German toll system (“MAUT”) will no longer apply only to heavy vehicles. The toll increase will also be linked to CO₂ emissions. The vast majority of vehicles will fall under CO₂ Emission Class 1, which is also the most expensive category.

CO₂ Emission Class 1 will include:

• All vehicles in Euro 0 – Euro V categories;
• All Euro VI vehicles registered before July 2019;
• Most Euro VI vehicles first registered after July 2019

Toll Collect is the name of the German federal authority responsible for toll collection and enforcement, which will classify all vehicles in CO₂ Emission Class 1. Owners of Euro VI vehicles first registered after July 2019 must check whether their vehicle may qualify for a better classification, using Toll Collect’s emission class checker.
Gas-powered vehicles (CNG/LNG) will continue to benefit from exemption from the German Lkw-Maut until December 31, 2023. Starting from January 1, 2024, these vehicles will be subject to the full tariff based on their respective Euro and CO₂ emission class.
It is also worth noting the change regarding vehicle classification by weight category. As of December 1, 2023, the basis for weight classification will no longer be the Maximum Permissible Weight (MPW), but the technically permissible total mass, i.e., the figure shown in the registration certificate in field F.1 instead of F.2.
In short, some vehicles that were previously exempt may now become subject to toll payment or fall into a different toll category.
These toll adjustments will inevitably impact freight forwarders: shipping and logistics companies will have to pay a surcharge per ton of CO₂.

Wissing, German Federal Minister for Transport and Digital Infrastructure, stated that the aim of these toll adjustments is to achieve “a moderate increase in tariffs in order to finance Germany’s infrastructure in the future.”
The German government identified three main objectives behind the Maut toll increase:

• 1. To promote the ecological transition towards lower-impact vehicles;
  2. To improve road conditions;
  3. To share costs with users who place the greatest burden on infrastructure.

It should be remembered that “Fit for 55” refers to the EU’s target of reducing net greenhouse gas emissions by at least 55% by 2030.
Starting from 2026, zero-emission trucks will be charged only 25% of the standard toll rate.

Unfortunately, we are once again compelled to address the issue of tariff increases.
The uncontrolled rise in diesel fuel prices at the pump is creating a particularly difficult situation to manage.

On the one hand, we are forced to accept increases from the carriers we work with daily—who in turn must refuel their vehicles at higher costs. On the other hand, we also understand how difficult it is to recover these additional expenses by passing them on to our customers, especially to those who planned their production months in advance, when this war was not at all foreseeable.

Unfortunately, this concerns our very survival and the continuity of the quality of our services. We therefore cannot afford not to recover these unexpected extra costs.

To address this issue, we have focused on implementing a mechanism that will protect us against both current and future sudden price hikes, while also taking into account a possible return to a more stable, pre-conflict situation.

The mechanism will be based on an official and transparent parameter: the diesel fuel price at the pump, as published on the websites of the Italian Ministry for Ecological Transition or the European Community Energy Observatory.

The starting parameter will be the average cost of ONE (1) liter of diesel during the week of January 18–24, 2022, when we last adjusted our tariffs based on the previous year’s data.
From this month onwards, a new item will be added to our current tariffs under the code PFS – Peak Fuel Surcharge, calculated as a percentage applied to traction charges.
For spot quotations, the fuel cost variation will already be included in the quote itself.

How will the PFS percentage be calculated?

The cost of diesel accounts for 30% of the total cost of transport. This means that the PFS will correspond to 28% of the variation compared to the previous week

Example:

– Date of transport: today, March 10, 2022
– Last available bulletin: March 8, 2022 – price €1.829,33/l
– Price on January 28, 2022: €1.667,29/l
– Difference: 1.829 ÷ 1.667 = 1.09
– Percentage increase in fuel cost: 11%
– 28% of 11 = 3.08 → the PFS on the freight charge will be 3.08% for the given week.
